Welcome to sambucnvuv. These Terms of Service ("Terms") govern your use of our fitness center facilities, services, and website located at sambucnvuv.life, operated by sambucnvuv B.V., a company registered in the Netherlands.

By accessing or using our services, becoming a member, or visiting our facility, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access our services or facilities.

These Terms apply to all visitors, users, members, and others who access or use our services. Your acceptance of these Terms creates a legally binding agreement between you and sambucnvuv.

Membership and Services

Membership Eligibility

To become a member of sambucnvuv, you must be at least 16 years of age. Members under 18 require parental or guardian consent. You must provide accurate and complete information during registration and maintain updated contact information throughout your membership.

Membership Types and Fees

sambucnvuv offers various membership plans with different access levels and pricing. Membership fees are due in advance and must be paid according to your chosen payment schedule. All fees are non-refundable except as specifically provided in these Terms or required by law.

Facility Access

Your membership grants you access to our fitness facilities during operating hours, subject to these Terms and our facility rules. Access may be restricted for maintenance, special events, or capacity limitations. We reserve the right to modify operating hours with reasonable notice.

Member Obligations and Conduct

As a member of sambucnvuv, you agree to:

• Follow all facility rules and staff instructions
• Treat staff, other members, and visitors with respect and courtesy
• Use equipment properly and safely as instructed
• Maintain appropriate hygiene and dress standards
• Keep your membership card or access credentials secure
• Report any injuries, accidents, or safety concerns immediately
• Pay all fees and charges on time
• Provide accurate health and contact information

Prohibited Activities

The following activities are strictly prohibited at our facility:

• Harassment, discrimination, or inappropriate behavior toward others
• Use of illegal substances or being under the influence of alcohol or drugs
• Bringing unauthorized guests or allowing others to use your membership
• Photography or recording without express written permission
• Soliciting, selling, or promoting outside services or products
• Damaging or misusing equipment or facilities
• Creating unreasonable disturbances or disruptions

Health and Safety

Medical Clearance

You represent that you are in good health and have no medical conditions that would prevent safe participation in physical exercise. We strongly recommend consulting with a healthcare provider before beginning any fitness program, especially if you have pre-existing health conditions.

Assumption of Risk

You acknowledge that physical exercise and use of fitness equipment involves inherent risks of injury. You voluntarily assume all risks associated with your use of our facilities and services, including but not limited to risks of personal injury, property damage, or death.

Emergency Procedures

In case of medical emergency, you authorize sambucnvuv staff to seek emergency medical care on your behalf and to share relevant health information with emergency responders. You are responsible for all costs associated with emergency medical care.

Payment Terms

Membership Fees

Membership fees are due according to your chosen payment schedule (monthly, quarterly, or annually). Fees must be paid in advance and are non-refundable except as specifically provided in these Terms. All prices are quoted in Euros and include applicable VAT.

Late Payments

If membership fees are not paid when due, your access to facilities may be suspended until payment is received. Late fees may apply as specified in your membership agreement. Continued non-payment may result in membership termination and referral to collection agencies.

Price Changes

sambucnvuv reserves the right to modify membership fees with 30 days' written notice. Existing members will have the option to continue under current terms for the remainder of their contract period or accept new pricing terms.

Intellectual Property

The sambucnvuv name, logo, website content, training materials, and all other intellectual property used in connection with our services are owned by sambucnvuv or our licensors and are protected by copyright, trademark, and other intellectual property laws.

You may not use, reproduce, distribute, or create derivative works from our intellectual property without express written permission. This includes but is not limited to our training programs, class formats, promotional materials, and proprietary methods.

Any feedback, suggestions, or ideas you provide to sambucnvuv may be used by us without restriction or compensation to you, and you waive any claims to ownership of such feedback.

Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By accepting these Terms, you also agree to our Privacy Policy.

You consent to our collection and use of your personal information as described in our Privacy Policy, including health-related information necessary for providing fitness services and ensuring facility safety.

Termination

Termination by Member

You may terminate your membership by providing 30 days' written notice to sambucnvuv. Termination will be effective at the end of your current billing period. No refunds will be provided for unused portions of prepaid membership fees except as required by law.

Termination by sambucnvuv

sambucnvuv may terminate your membership immediately without notice if you:

• Violate these Terms or facility rules
• Engage in conduct that endangers others or disrupts operations
• Fail to pay membership fees when due
• Provide false or misleading information
• Use facilities in a manner inconsistent with their intended purpose

Effect of Termination

Upon termination, your right to access our facilities and services ends immediately. You must return any access cards or equipment provided by sambucnvuv. Provisions of these Terms that by their nature should survive termination will continue to apply.

Limitation of Liability

To the maximum extent permitted by law, sambucnvuv's total liability to you for any claims arising from or related to these Terms or your use of our services shall not exceed the amount of membership fees paid by you in the 12 months preceding the claim.

sambucnvuv shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, even if we have been advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

Indemnification

You agree to indemnify, defend, and hold harmless sambucnvuv, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

• Your use or misuse of our facilities or services
• Your violation of these Terms
• Your violation of any rights of another party
• Your negligent or wrongful conduct

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to conflict of law principles. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in Amsterdam, Netherlands.

If you are a consumer residing in the European Union, you may also bring proceedings in the courts of the country where you live, and you may benefit from any mandatory provisions of the law of the country where you live.

Dispute Resolution

Before filing any formal legal proceedings, you agree to first contact sambucnvuv to seek resolution of any dispute. We are committed to resolving disputes amicably and in good faith.

For consumer disputes, you may also use the European Commission's Online Dispute Resolution platform, available at ec.europa.eu/consumers/odr, or contact relevant consumer protection authorities in your jurisdiction.

Force Majeure

sambucnvuv shall not be liable for any failure or delay in performance under these Terms that is due to causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, government actions, or public health emergencies.

In the event of force majeure, sambucnvuv will make reasonable efforts to minimize disruption and may offer alternative arrangements or membership extensions as appropriate.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be replaced with a valid provision that most closely matches the intent of the original provision.

Changes to Terms

sambucnvuv reserves the right to modify these Terms at any time. We will provide notice of material changes by:

• Posting updated Terms on our website with a new effective date
• Sending email notification to members
• Posting notices at our facility

Your continued use of our services after any changes constitutes acceptance of the new Terms. If you do not agree to the modified Terms, you may terminate your membership as provided in these Terms.

Entire Agreement

These Terms, together with our Privacy Policy and any additional terms specific to certain services, constitute the entire agreement between you and sambucnvuv regarding your use of our services and supersede all prior agreements and understandings.

No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or condition or any other term or condition.
